Terms of Use

1. Agreement

By using this website or making a donation through it, you agree to these terms. If you do not agree, please do not use the site. These terms are governed by Indian law, and the courts at Bhopal, Madhya Pradesh have exclusive jurisdiction.

2. About the organisation

This site is operated by GiveBharat Foundation, a public charitable trust registered in India, with its registered office at 2nd Floor, Shanti Complex, Near Hamidia Hospital Road, Shahjahanabad, Bhopal 462001.

3. Donations

• All donations are voluntary and, except as set out in our Refund Policy, non-refundable.
• Donations are accepted in Indian Rupees only, from Indian bank accounts and Indian-issued payment instruments.
• Foreign contributions: we do not hold registration under the Foreign Contribution (Regulation) Act, 2010, so we cannot accept donations that constitute a foreign contribution. If you are a foreign national or a foreign-source entity, please do not donate through this site.
• You confirm that the funds you donate are from a lawful source and that you are authorised to use the payment instrument.

4. Use of donations

Gifts made to a named campaign are ring-fenced to that programme. Gifts to the general fund are allocated by our programme committee to the area of greatest need.

If a campaign is over-subscribed, or a programme cannot proceed as planned, we will contact each restricted donor and offer the choice of redirecting the gift to another programme or receiving a refund. We will not silently reallocate restricted funds.

We reserve the right to apply up to 16% of any donation to supervision, administration and fundraising costs, consistent with the expenditure ratio published on our Impact page.

5. Tax treatment

Donations made through this site are not tax-deductible. GiveBharat Foundation does not currently hold registration under Section 80G of the Income Tax Act, 1961, and we do not issue 80G certificates. We will not tell you otherwise, and you should not claim a deduction against a donation made here.

You will receive a payment receipt by email, with a receipt number, for your own records.

Nothing on this site is tax advice. Consult a qualified professional about your own position.

6. Payments

Payments are processed by Razorpay Software Private Limited. Your use of that service is additionally subject to Razorpay's own terms. We are not liable for failures, delays or errors originating in the payment gateway, your bank or your network — though we will help you resolve them.

7. Acceptable use

You may not use this site to transmit malicious code, attempt unauthorised access to any system, scrape data at a rate that degrades service for others, impersonate another person, or submit false information through any form.

8. Intellectual property

All text, photographs, films, graphics and design on this site are owned by GiveBharat Foundation or used under licence. You may quote and link to our content with attribution. You may not reproduce our photographs of programme participants, republish substantial portions of our content, or use our name or logo to solicit funds without our written permission.

9. Photographs and consent

Images of programme participants are published with consent. If you are pictured on this site, or are the parent or guardian of a child who is, write to hello@givebharat.org and we will remove the image without requiring an explanation.

10. Third-party links

We link to government portals and partner organisations for verification purposes. We are not responsible for the content or practices of those sites.

11. Limitation of liability

The site is provided on an "as is" basis. To the extent permitted by law, our aggregate liability arising from your use of this site is limited to the amount of any donation you made in the 12 months preceding the claim. Nothing here limits liability for fraud or for anything that cannot lawfully be limited.

12. Changes

We may update these terms. Continued use of the site after a change constitutes acceptance of the revised terms.
